Each itinerary is individually designed according to the client's interests, travel style, budget and preferences. We do not sell fixed package holidays; every journey is tailor-made.
OUR PHILOSOPHY
At Usahili, we believe travel should be personal, authentic and unforgettable.
Our goal is to create carefully designed journeys that allow our clients to experience Kenya through trusted local expertise, exceptional service and meaningful cultural connections.
Every itinerary is individually prepared with care and attention to detail. We work closely with carefully selected accommodation providers, guides and local operators who share our commitment to quality, professionalism, safety and responsible tourism.
Although travel occasionally involves circumstances beyond anyone's control, our commitment is always to support our clients, communicate openly and provide practical solutions whenever challenges arise.
DEFINITIONS
For the purpose of these Booking Conditions:
• Booking Confirmation means the written confirmation issued by Usahili after accepting your booking. • Booking Contract means the legally binding agreement between you and Usahili. • Lead Passenger means the person making the booking and accepting these Booking Conditions on behalf of everyone travelling. • Holiday means the tailor-made travel arrangements purchased from Usahili. • Supplier means any independent company providing services including hotels, safari operators, transfer providers, excursion providers, restaurants, airlines or any other third-party supplier. • Travel Documents include passports, visas, vaccination certificates and any documentation required for international travel. • Working Day means Monday to Friday excluding public holidays in England.
YOUR CONTRACT WITH USAHILI
Your contract with Usahili begins when:
• You accept our quotation; • You pay the required deposit; and • We issue your Booking Confirmation.
Until all three stages have been completed, no contract exists.
The Lead Passenger confirms they are at least 18 years of age and have the legal authority to enter into this agreement on behalf of every traveler included within the booking.
The Lead Passenger accepts responsibility for ensuring that all travelers have read and accepted these Booking Conditions.
BESPOKE HOLIDAY ARRANGEMENTS
Every holiday created by Usahili is individually designed.
Unlike standard package holidays, each itinerary is tailored specifically for the client and may include:
• Accommodation • Safari experiences • Private or shared transfers • Excursions • Marine activities • Snorkelling • Cultural experiences • Conservation activities • Other tourism services agreed during the planning process
As every itinerary is bespoke, quotations are prepared individually and are based upon supplier availability at the time of quotation.
The preparation of a personalized itinerary requires significant planning and coordination with our suppliers.
QUOTATIONS
All quotations provided by Usahili are:
• Personalized; • Subject to availability; • Non-binding until confirmed; • Based on supplier prices available at the time of quotation.
Unless otherwise stated, quotations remain valid for 14 calendar days.
After this period, prices may be amended due to supplier price changes, exchange rate fluctuations, taxes, government charges or availability.
No booking is confirmed until the required deposit has been received and Booking Confirmation has been issued.
PRICING
Prices are generally quoted in Pounds Sterling (GBP).
For the convenience of our clients, payments may also be accepted in Euros (EUR).
Where payment is made in Euros, the applicable exchange rate used by our payment provider or financial institution shall apply.
Usahili shall not be responsible for any additional charges, exchange rate variations or bank fees imposed by financial institutions.
PRICE CHANGES
Prior to booking confirmation, Usahili reserves the right to amend any quotation without notice where supplier costs change.
After a booking has been confirmed, prices will remain fixed except where changes are permitted under applicable UK law, including but not limited to:
• Government taxes; • Park entry fees; • Conservation levies; • Airport charges; • Currency fluctuations; • Transport costs; • Fuel surcharges; • Mandatory local authority fees.
Should a significant price increase become necessary, Usahili will inform you as soon as reasonably possible and explain the options available to you under applicable law.
FINANCIAL PROTECTION
Where applicable, payments for bookings protected through the Travel Trust Association ("TTA") shall be held within the designated TTA Trust Account in accordance with the relevant financial protection arrangements.
Clients will receive confirmation of the applicable financial protection arrangements at the time of the booking.
Where financial protection does not apply to a particular service, this will be clearly communicated before the booking is confirmed.
ACCEPTANCE OF THESE TERMS
By paying the required deposit, signing electronically, replying in writing confirming acceptance, or otherwise instructing Usahili to proceed with your booking, you acknowledge that:
• You have read these Booking Conditions; • You understand them; • You accept them on behalf of all travelers included in your booking; and • These Booking Conditions form part of your legally binding contract with Usahili.
BOOKING PROCEDURE
11.1 All holidays arranged by Usahili are individually designed following discussions with the client regarding travel dates, budget, interests and personal preferences.
11.2 A booking request may be made by email, telephone, WhatsApp or any other communication method approved by Usahili.
11.3 Following your enquiry, Usahili will prepare a personalized quotation and proposed itinerary.
11.4 A booking shall only become confirmed once:
• The Lead Passenger has accepted the quotation; • The required deposit has been paid; • These Booking Conditions have been accepted; and • Usahili has issued a written Booking Confirmation.
11.5 Until written confirmation has been issued, Usahili reserves the right to amend or withdraw any quotation.
DEPOSIT
12.1 A non-refundable deposit equal to 20% of the total holiday cost is required to secure your booking.
12.2 No services will be confirmed until the deposit has been received.
12.3 Payment of the deposit confirms acceptance of these Booking Conditions.
12.4 The deposit forms part of the overall holiday price.
12.5 Certain suppliers may require higher deposits. Where this applies, Usahili will inform you before your booking is confirmed.
FINAL PAYMENT
13.1 The remaining balance must be paid no later than 8 weeks prior to departure, as specified on your Booking Confirmation.
13.2 If payment is not received by the due date, Usahili reserves the right to:
• Cancel the booking; • Retain the deposit; • Apply cancellation charges in accordance with these Booking Conditions.
13.3 Travel documents may not be released until payment has been received.
PAYMENT METHODS
Payments may be made using approved payment methods communicated by Usahili, including:
• Bank transfer • Debit / Credit cards • Other authorized payment platforms.
All protected payments shall be made into the designated Travel Trust Association (TTA) Trust Account.
The client is responsible for any bank transfer fees or currency conversion charges imposed by their financial institution.
PAYMENT FRAUD
Usahili reserves the right to:
• Verify payment details; • Request proof of identity; • Refuse payments where fraud is suspected; • Cancel bookings obtained through fraudulent payment methods.
Any fraudulent activity may be reported to the relevant authorities.
CUSTOMER REQUESTED AMENDMENTS
16.1 If you wish to amend your booking after confirmation, Usahili will make every reasonable effort to accommodate your request.
16.2 Amendments are subject to:
• Supplier availability; • Operational feasibility; • Additional supplier charges.
16.3 An administration fee of £50 per person will apply to each requested amendment, in addition to any charges imposed by suppliers.
16.4 Examples of amendments include:
• Change of travel dates; • Change of accommodation; • Adding or removing services; • Changing passenger names where permitted; • Modifying transfers; • Altering safari arrangements.
16.5 Certain amendments may not be possible after bookings have been confirmed with suppliers. Usahili cannot guarantee that every requested amendment can be accommodated.
TRANSFER OF BOOKING
Where permitted by applicable law and supplier conditions, the Lead Passenger may request that another suitable person takes their place.
Such requests must:
• Be made in writing; • Be received within a reasonable period before departure; • Satisfy all supplier requirements.
Any additional costs incurred shall be payable by the client.
Usahili reserves the right to refuse a transfer where suppliers do not permit such changes.
CUSTOMER CANCELLATIONS
If you wish to cancel your booking, notice must be given in writing by the Lead Passenger.
The cancellation shall become effective on the date written notice is received by Usahili.
Cancellation charges are calculated as follows:
More than 70 days — Loss of deposit 69–42 days — 30% of holiday cost 41–28 days — 60% of holiday cost 27–15 days — 80% of holiday cost 14 days or less — 100% of holiday cost
Certain suppliers may impose higher cancellation charges. Where applicable, these shall replace the standard scale above if they exceed the stated amounts.
REFUNDS
Where a refund is due, Usahili shall process the refund as soon as reasonably practicable.
Refunds shall normally be made using the original payment method.
Usahili shall not be responsible for:
• Exchange rate losses; • Bank charges; • Intermediary payment fees.
Refund processing times may vary depending upon banking institutions.
IF WE CHANGE YOUR HOLIDAY
Because every itinerary is bespoke, occasional changes may become necessary.
Usahili reserves the right to make minor changes where these do not materially affect the enjoyment of your holiday.
Examples include:
• Different transfer timings; • Equivalent accommodation; • Revised excursion schedules; • Alternative safari routes; • Substitute guides.
Minor changes shall not normally give rise to compensation.
SIGNIFICANT CHANGES
If, before departure, Usahili is required to make a significant change to your holiday, we will inform you as soon as reasonably possible.
Depending upon the circumstances, you may be offered:
• An equivalent alternative; • A higher standard alternative (where available); • A lower standard alternative together with an appropriate refund of the price difference; • A cancellation of your booking with any refund required by law.
IF USAHILI HAS TO CANCEL YOUR HOLIDAY
In rare circumstances, Usahili may need to cancel your holiday.
Examples include:
• Supplier insolvency; • Safety concerns; • Natural disasters; • Government restrictions; • Political instability; • Force majeure; • Insufficient availability of essential services.
Where cancellation is necessary, Usahili will make every reasonable effort to offer a suitable alternative.
Where no suitable alternative can be provided, refunds will be issued in accordance with applicable law.
SUPPLIER FAILURE
Usahili carefully selects its accommodation providers, safari operators and local partners.
However, should a supplier become unable to provide contracted services due to insolvency, closure or other unforeseen circumstances, Usahili reserves the right to substitute those services with an alternative of equivalent or higher quality wherever reasonably possible.
If only a lower standard alternative is available, the client shall receive an appropriate refund reflecting the difference in value.
ACCOMMODATION SUBSTITUTIONS
Accommodations occasionally experience circumstances beyond their control, including:
• Overbooking; • Maintenance issues; • Unexpected closure; • Safety concerns; • Force majeure.
Where this occurs, Usahili will endeavour to arrange accommodation of an equivalent or superior standard.
Should only accommodation of a lower standard be available, the client will receive a refund representing the difference in price.
QUOTATION ERRORS
Although every effort is made to ensure accuracy, Usahili reserves the right to correct any obvious pricing errors, typographical mistakes or administrative inaccuracies before or after booking where permitted by law.
Clients will be informed promptly should such an error occur.
CLIENT RESPONSIBILITY FOR INFORMATION
Clients are responsible for ensuring that:
• All passenger names exactly match passports; • Dates of birth are correct; • Passport details are accurate; • Contact information is kept up to date.
Usahili accepts no responsibility for costs arising from incorrect information supplied by the client.
TRAVEL INSURANCE
27.1 Comprehensive travel insurance is mandatory for every traveler booked with Usahili.
27.2 Insurance must be purchased before travel and remain valid for the entire duration of the holiday.
27.3 Your policy should provide adequate cover for, where applicable:
• Medical expenses • Emergency medical treatment • Emergency evacuation • Repatriation • Trip cancellation • Curtailment • Personal liability • Loss, theft or damage to baggage • Travel delays • Missed departures • Personal accident • Activities included within your itinerary, such as safaris, snorkelling and other adventure or water-based activities.
27.4 It is your responsibility to ensure that your insurance policy provides sufficient cover for your individual circumstances.
27.5 Failure to obtain appropriate travel insurance may result in Usahili refusing your booking if we reasonably believe that travelling without insurance could expose you or others to unacceptable financial or safety risks.
PASSPORTS, VISAS & ENTRY REQUIREMENTS
28.1 It is the sole responsibility of every traveler to ensure that they possess valid travel documentation. This includes, where applicable:
• Passport • Visa • Electronic Travel Authorisation (ETA) • Vaccination certificates • Health declarations • Customs documentation
28.2 Passport validity requirements vary between destinations and may change without notice.
28.3 Usahili accepts no responsibility for:
• Refused boarding; • Refused entry; • Immigration delays; • Deportation; • Additional costs arising from inadequate travel documentation.
28.4 Clients should regularly check the latest official travel advice and entry requirements before departure.
HEALTH REQUIREMENTS
29.1 Clients are responsible for ensuring they are medically fit to travel.
29.2 If any traveler suffers from:
• A medical condition; • Reduced mobility; • Pregnancy; • Disability; • Severe allergies; • Mental health condition; • Or any other circumstance that may affect travel,
Usahili should be informed before booking wherever reasonably possible.
29.3 This information enables us to determine whether suitable arrangements can reasonably be made.
Failure to disclose relevant information may affect the suitability or safety of your travel arrangement.
PREGNANCY
Travelers who are pregnant are responsible for obtaining appropriate medical advice before travel.
Certain airlines, accommodation providers and activity operators may apply restrictions depending upon the stage of pregnancy.
Usahili reserves the right to request written medical clearance where considered reasonably necessary.
ALLERGIES & DIETARY REQUIREMENTS
31.1 Usahili will use reasonable efforts to communicate dietary requirements and allergies to suppliers.
31.2 However, meals are prepared by independent third-party providers. Accordingly, Usahili cannot guarantee that meals will be completely free from allergens or cross-contamination.
31.3 Clients with severe allergies remain responsible for exercising appropriate caution throughout their holiday.
31.4 Where allergies are life-threatening, clients should carry all necessary medications, including emergency medication where prescribed.
VACCINATIONS & HEALTH PRECAUTIONS
Travelers remain responsible for obtaining professional medical advice regarding:
• Recommended vaccinations; • Malaria prevention; • Mosquito bite protection; • Food and water hygiene; • Local health advice.
Health recommendations may change and should be checked shortly before departure.
FITNESS TO PARTICIPATE
Certain activities require an appropriate level of physical fitness. These may include:
• Safaris • Boat excursions • Snorkelling • Hiking • Walking tours • Water sports
Clients participate entirely at their own risk and should only participate if they are physically capable of doing so.
Usahili reserves the right to refuse participation where a supplier reasonably believes that participation would endanger the traveler or others.
FLIGHTS
At the time these Booking Conditions were published, Usahili does not hold an Air Travel Organiser's Licence (ATOL).
Accordingly:
• Usahili does not currently organize or sell ATOL-protected flight-inclusive package holidays. • Unless expressly confirmed otherwise in writing, international flights must be arranged independently by the client. • Where Usahili provides general flight suggestions or recommendations, these are provided for convenience only and do not form part of the Booking Contract.
If Usahili obtains an ATOL Licence in the future, separate terms relating to flight-inclusive holidays may apply.
TRANSFERS
Transfers may be provided on either a private or shared basis, depending on the itinerary selected and the client's preferences.
Transfer times are estimates only and may vary due to:
• Traffic conditions; • Weather; • Roadworks; • Ferry schedules; • Police checkpoints; • Local events; • Other operational circumstances beyond reasonable control.
Reasonable delays shall not constitute a breach of contract.
Clients who fail to arrive at the agreed collection point at the agreed time may be treated as having missed the transfer. Additional charges may apply for replacement transport.
SAFARI
Safaris involve travel through natural environments where conditions may change rapidly.
Clients acknowledge that:
• Wildlife is unpredictable; • Sightings cannot be guaranteed; • Routes may change; • Timings may vary; • Weather may affect activities; • Conservation authorities may restrict access to certain areas.
Safari guides retain absolute discretion regarding safety decisions during excursions.
Clients agree to follow all instructions provided by guides at all times.
WILDLIFE DISCLAIMER
Wild animals are inherently unpredictable. Usahili cannot guarantee sightings of any particular species.
Wildlife behavior may require safari vehicles to alter routes, shorten game drives or leave particular areas.
No compensation shall be payable where wildlife sighting differs from expectations.
EXCURSIONS
Excursions are operated subject to:
• Weather conditions; • Operational requirements; • Minimum participant numbers where applicable; • Safety considerations; • Local authority requirements.
Excursions may occasionally be modified or cancelled without prior notice where necessary for safety or operational reasons.
Where possible, suitable alternatives will be offered.
SNORKELLING & WATER ACTIVITIES
Participation in snorkelling and other marine activities involves inherent risks. These include, but are not limited to:
• Strong currents; • Changing sea conditions; • Marine wildlife; • Slips and falls; • Equipment failure beyond reasonable control.
Participants confirm that:
• They are able to swim unless otherwise agreed with the operator; • They will follow all safety instructions; • They will use equipment responsibly; • They will immediately inform the guide of any medical concerns.
Activities may be cancelled or shortened where sea conditions make operation unsafe.
WEATHER CONDITIONS
Weather may significantly affect:
• Safari activities; • Boat excursions; • Marine activities; • Road travel; • Wildlife movements.
Usahili cannot guarantee favorable weather conditions and shall not be liable where weather affects the enjoyment of any activity.
NATIONAL PARKS & CONSERVATION AREAS
National Parks and Marine Parks operate under the authority of the relevant Kenyan authorities.
Entry fees, opening hours, conservation rules and access restrictions may change without notice.
Usahili shall not be responsible for decisions made by park authorities.
RESPECT FOR WILDLIFE & THE ENVIRONMENT
Clients agree to:
• Respect wildlife; • Avoid disturbing animals; • Comply with conservation rules; • Avoid littering; • Refrain from feeding wildlife; • Follow all guide instructions.
Failure to comply may result in removal from an activity without refund.
LOCAL LAWS & CUSTOMS
Travelers are responsible for complying with all applicable laws and regulations of the destination visited.
Clients are expected to respect local customs, traditions, communities and cultural sensitivities throughout their journey.
Usahili reserves the right to refuse participation in activities where client behaviour risks causing offence, legal issues or safety concerns.
SUSTAINABLE TRAVEL
Usahili is committed to promoting responsible and sustainable tourism. Where reasonably possible, we seek to:
• Support local communities; • Work with responsible suppliers; • Encourage environmental conservation; • Minimize unnecessary waste; • Promote ethical wildlife tourism.
Clients are encouraged to support these principles throughout their holiday.
FORCE MAJEURE
45.1 Except where otherwise required by applicable law, Usahili shall not be liable for any failure to perform, delay in performing, or alteration to any part of the Holiday where such failure, delay or alteration results from circumstances beyond our reasonable control ("Force Majeure").
45.2 Force Majeure includes, but is not limited to:
• Natural disasters (including floods, earthquakes, droughts, volcanic activity and wildfires) • Severe weather conditions • Pandemics or epidemics • Public health emergencies • Government restrictions or travel bans • Acts of terrorism or the threat of terrorism • Civil unrest, riots or political instability • War or threat of war • Industrial disputes, strikes or lockouts • Airport, port or borders closures • Air traffic control restrictions • Mechanical failures affecting transport providers • Fire, explosion or structural damage • Cyber-attacks affecting essential travel services • Power failures or widespread utility outages • Decisions made by local authorities, conservation authorities or national park authorities • Any other extraordinary event beyond the reasonable control of Usahili or its suppliers.
45.3 In such circumstances, Usahili will make reasonable efforts to minimize disruption and provide suitable alternatives where practicable.
45.4 Force Majeure does not automatically entitle the client to compensation, although statutory rights remain unaffected.
SUPPLIERS
46.1 Usahili acts as the organizer of your tailor-made holiday and contracts with a number of carefully selected independent suppliers.
46.2 These suppliers may include:
• Hotels • Lodges • Villas • Safari operators • Transfer providers • Boat operators • Activity providers • Restaurants • Professional guides • Conservation organizations • Other tourism service providers.
46.3 Each supplier remains responsible for providing its services with reasonable care and skills in accordance with applicable local laws and regulations.
46.4 Usahili carefully selects its suppliers but cannot control every aspect of their day-to-day operations.
46.5 Where problems arise, Usahili will make reasonable efforts to assist the Client and coordinate appropriate solutions.
OUR LIABILITY
47.1 Usahili accepts responsibility for providing the travel services included within the Booking Confirmation with reasonable care and skills.
47.2 Nothing in these Booking Conditions limits or excludes liability for:
• Death or personal injury caused by negligence; • Fraud or fraudulent misrepresentation; • Any liability which cannot legally be excluded under the laws of England and Wales.
47.3 Subject to applicable law, Usahili shall not be liable for:
• Indirect or consequential losses; • Loss of enjoyment arising from events beyond our reasonable control; • Loss of business; • Loss of earnings; • Emotional distress not resulting from a breach of contract; • Costs arising from the Client's failure to comply with these Booking Conditions.
LIMITATION OF LIABILITY
48.1 Where legally permitted, the total liability of Usahili shall not exceed the total price paid for the Holiday, except where a higher limit is required by law.
48.2 This limitation does not affect any statutory rights available to consumers.
CLIENT RESPONSIBILITIES
Throughout the Holiday, Clients agree to:
• Act responsibly and respectfully; • Comply with local laws; • Follow safety instructions; • Treat suppliers, guides and local communities courteously; • Avoid behaviour likely to endanger themselves or others; • Safeguard their personal belongings; • Exercise reasonable care during all activities.
UNACCEPTABLE BEHAVIOUR
Usahili reserves the right to refuse a booking or terminate travel arrangements without refund where a client:
• Behaves violently; • Behaves abusively; • Threatens staff or suppliers; • Places others at risk; • Damages property; • Commits criminal offences; • Is seriously intoxicated; • Uses illegal drugs; • Repeatedly ignores safety instructions.
Any additional costs arising from such behaviour shall be the responsibility of the Client.
COMPLAINTS DURING THE HOLIDAY
If you experience any difficulty during your Holiday, you must notify:
The relevant local supplier (where appropriate); and
Usahili as soon as reasonably possible.
This gives us the opportunity to investigate and, where possible, resolve the issue promptly.
Failure to report a problem during the Holiday may reduce our ability to resolve it and may affect any subsequent claim.
COMPLAINTS AFTER YOUR HOLIDAY
If your complaint has not been resolved during your Holiday, you should submit it in writing to Usahili within 28 days of returning home.
Complaints should include:
• Booking reference; • Dates of travel; • Full details of the complaint; • Supporting evidence where available.
Usahili aims to acknowledge complaints promptly and respond within a reasonable period.
EMERGENCY ASSISTANCE
Where Clients experience genuine emergencies during their Holidays, Usahili will provide reasonable assistance.
This may include:
• Contacting suppliers; • Locating local medical services; • Assisting with communication; • Providing practical information.
Any costs charged by third parties remain the responsibility of the Client unless otherwise agreed.
LOST PROPERTY
Usahili cannot accept responsibility for lost, stolen or damaged personal belongings.
Where reasonably possible, we will assist Clients in contacting the relevant supplier regarding lost property.
Recovery or return of lost items cannot be guaranteed.
PHOTOGRAPHY & MARKETING
Usahili may occasionally request permission to use photographs or videos taken during your Holiday for marketing purposes.
Your consent will always be requested before identifiable images are used.
Clients are under no obligation to provide such consent, and declining consent will not affect the services provided.
DATA PROTECTION
Usahili processes personal information in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Personal information will only be shared with suppliers where necessary to arrange your Holiday.
ELECTRONIC COMMUNICATIONS
Clients agree that communications may be sent electronically, including by:
• Email; • WhatsApp; • Secure messaging platforms; • Electronic booking systems.
Electronic communications shall be deemed received when successfully transmitted, unless evidence indicates otherwise.
INTELLECTUAL PROPERTY
All itineraries, travel proposals, photographs, branding, logos, written contents and other materials prepared by Usahili remain the intellectual property of Daria Pea Limited unless otherwise stated.
Clients may use such materials solely for their personal travel arrangements.
No material may be copied, reproduced, distributed or used commercially without prior written consent.
FRAUD & CHARGEBACKS
Clients agree not to initiate unjustified payment disputes or chargebacks where services have been provided in accordance with the Booking Contract.
Where an unjustified chargeback is initiated, Usahili reserves the right to recover all reasonable costs incurred, including administrative expenses, legal fees and bank charges, where permitted by law.
Nothing in this clause affects the Client's right to raise legitimate disputes regarding unauthorized transactions or services not provided.
SEVERABILITY
If any provision of these Booking Conditions is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
NO WAIVER
Failure by Usahili to enforce any provision of these Booking Conditions shall not constitute a waiver of that provision or any other rights.
ENTIRE AGREEMENT

GOVERNING LAW & JURISDICTION
These Booking Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from these Booking Conditions, subject to any mandatory consumer rights that apply under applicable law.
